What Is Land Trust?

A land trust is a legal arrangement in which a trustee holds title to property for the benefit of one or more beneficiaries.

In essence, a land trust allows the property owner to separate the control and benefits of owning property from the legal ownership of the property itself.

Conservation Land Trusts: Aimed at preserving open space, natural resources, and wildlife habitats. These trusts might restrict development to protect ecological or historical values.

Real Estate Investment Trusts (REITs): While not exactly land trusts, REITs are a form of trust investment that involves real estate and operates under different legal frameworks, focusing on income-generating properties.

Community Land Trusts: Focus on affordable housing and community development. These trusts often aim to maintain affordable housing options over time by controlling land use and ownership.

Common Misconceptions About the Meaning of Land Trust

One common misconception is that land trusts are solely for the wealthy or for hiding assets. While privacy and estate planning are benefits, land trusts also serve public interests, such as conservation and affordable housing.

Another misconception is that a land trust offers complete protection against liens and legal judgments. While it provides privacy and may offer some level of protection by complicating asset searches, creditors can still potentially reach the assets within a trust if they can prove ownership or beneficial interest by the debtor.

Lastly, there's sometimes confusion between land trusts and other types of trusts or corporate structures used in real estate, like REITs or LLCs. Each has distinct legal, financial, and operational characteristics designed for specific purposes, benefits, and limitations.
